The Wisconsin Supreme Court race has been hit with an election bribery scheme, orchestrated by the liberal group Wisconsin Takes Action. Thousands of Wisconsin residents have received texts offering them the chance to earn money by talking to friends and family about voting. However, the offer is not as simple as it seems and in fact amounts to election bribery, a felony in Wisconsin punishable by a maximum sentence of more than three years in prison.
Relational Organizing Tactics
The group is using a technique called “relational organizing” in which participants are paid to talk to people they know about voting for liberal candidate Janet Protasiewicz. This is in direct violation of Wisconsin Statute § 12.11, which prohibits offering anything of value in exchange for inducing electors to vote for a specific candidate.
Gift Cards and Payments
Participants can earn a total of $270, with the potential to earn more, by following a set of steps from February 22nd to April 4th. They will receive gift cards from retailers such as Amazon, Walmart, Target, and Kroger or digital services like Uber, Uber Eats and Xbox, or a prepaid Mastercard. The gift cards will be emailed directly to the participants, who are being paid by the vote to deliver votes for Protasiewicz.

Wisconsin Takes Action proudly listed liberal organizations such as the Black Lives Matter PAC, Freedom Action Now, One Fair Wage, End Citizens United, Wisconsin Conservation Voters, and Nextgen America as partners on their website. Two large labor unions, the American Federation of Teachers and the American Federation of State, County, and Municipal Employees (AFSCME), are also listed as partners. The main force behind Wisconsin Takes Action is the Organizing Empowerment Political Action Committee (PAC), which spent more than $300,000 in support of Democratic Senate candidates during the 2022 midterm election cycle.
This election bribery scheme may serve as a test run for the group, as they plan to expand the effort into swing states for the 2024 presidential election. The group has not yet responded to a request for comment about their program and whether they believe it complies with state law.
The Consequences of Election Bribery
The actions taken by Wisconsin Takes Action are a direct violation of Wisconsin Statute § 12.11 and the consequences of their actions could be severe. Not only is election bribery a felony in Wisconsin, punishable by a maximum sentence of more than three years in prison, but it undermines the integrity of the election process. The purpose of elections is for citizens to freely and fairly choose their representatives, but election bribery distorts the outcome of the election by paying people to influence the vote.
