In a disturbing turn of events, New York’s Democratic Governor Kathy Hochul has sought judicial approval to establish “quarantine camps” for involuntary detainment of citizens, even though such camps have been deemed unconstitutional. This contentious move has ignited widespread apprehension, as it implies the arbitrary confinement of New Yorkers without due process, legal rights, or a set duration, all determined by state health officials.

Adding to the disquiet is the absence of age restrictions, suggesting that even vulnerable children could be separated from their families and placed in these detention centers. The pandemic prompted New York officials to propose a new rule authorizing the state to implement such drastic measures.

Governor Hochul has returned to court, renewing her request for permission to detain New Yorkers in quarantine camps. This development has incited widespread unease, leading many to question the legitimacy of such action. The prospect of the state detaining citizens without appropriate legal recourse is seen as a severe infringement on civil liberties and sets a dangerous precedent with potentially far-reaching consequences.

Governor Hochul’s “Isolation and Quarantine Procedures” proposal encompasses the contentious detention camps, which have faced considerable public resistance. A lawsuit filed in response to the plan in April 2022 resulted in the scheme being declared unconstitutional.

Following the lawsuit, Judge Ronald Ploetz ruled several weeks later that the plan did not meet the standards set by the U.S. Constitution. Despite this ruling, Governor Hochul, through her Attorney General Letitia James, is now appealing the court’s rejection of her plan, as reported by Bobbie Anne Flower Cox, an attorney at the Brownstone Institute.

The case, Borrello v. Hochul, won in July of last year, was filed against the governor and her Department of Health by a group of NYS Legislators, including Senator George Borrello, Assemblyman Chris Tague, Assemblyman (now Congressman) Mike Lawler, along with their citizens’ group, Uniting NYS. The case spotlights the contentious issue of the state’s power to detain citizens without proper legal recourse and has ignited a heated debate concerning civil liberties in New York.

The Borrello v. Hochul case, won in July of last year, primarily focused on a breach of Separation of Powers, as Governor Hochul and her Department of Health were deemed to lack the authority to establish their “Isolation and Quarantine Procedures” regulation. According to Bobbie Anne Flower Cox, an attorney at the Brownstone Institute, the rule enabled the Department of Health to arbitrarily select New Yorkers for detention or lockdown, regardless of actual exposure to a communicable disease.

Cox further explained that state authorities would have been authorized to detain individuals in the camps indefinitely, without any legal recourse or age limits, and that individuals could have been forcibly removed from their homes without appeal. She added that the regulation lacked a procedure for release from quarantine, leaving citizens without any means to negotiate their way out.

In a revealing move, Governor Hochul did not file an appeal to overturn this controversial regulation until after a crucial election. The plaintiffs in the case released a statement expressing their disappointment with the state’s continued pursuit of such an extreme plan, emphasizing the importance of the constitutional separation of powers and the right to due process. They further underscored that the notion of a state agency unilaterally adopting a policy that mandates authoritarian-style isolation and quarantine procedures would have been unimaginable just a few years ago, and that the unconstitutional power grab must be stopped in its tracks.
